Chapter 4

Buildings and Building Regulations

Sec. 4-1. Standard Building Code. The 1998 edition of the Standard Building Code, including appendices, as promulgated by the Southern Building Code Congress International, Inc. and as required by Section 553.73, Florida Statutes, the State Minimum Building Code, is hereby adopted as an Ordinance of the TOWN by reference as through it were copied fully herein; provided, however,

A. Section 103.5, 1998 Standard Building Code entitled Unsafe Buildings or Systems is hereby amended to provide for application of the Section only to buildings which in the determination of the Town Council have been abandoned by the owner of the subject property.

B. In the event of an upgraded or revised edition of the Standard Building Code shall be published, adopted by the Southern Building Code Conference and approved by the appropriate agencies of the State of Florida, the Ordinances of the Town of Hastings, Florida shall be deemed as automatically amended to include the latest provisions of said codes without the necessity of amending the previously adopted Ordinances of the Town related to the adoption of the Standard Building Code. The Town Council intends by this Ordinance to require compliance with the latest editions of the Standard Building Code as same are amended from time to time, provided that all amendments, revisions, exclusions or additions as provided by the Ordinances of the Town are also hereby adopted from said amendments and revisions. The amendments shall become effective within 60 days after this publication provided the Town Council by resolution finds that such updated or amended Standard Building Code has been examined by the Town Clerk or a Building Official appointed by the Town Council after publication, that the State of Florida has approved the provisions published and that the Town Council finds no basis to prevent automatic adoption.

Codifer's notes: The 2004 Town Charter, adopted effective October 1, 2005, changes the title of the Town Council to Town Commission and the title of the Town Clerk to Town Manager. See Sections 1.4 and 1.8. The building official will be appointed by the Town Manager. See Section 1.9 (c).

Sec. 4-2. Standard Housing Code. The Standard Housing Code, 1997 Edition, as promulgated by the Southern Building Code Congress International, Inc.( 1997 Standard Housing Code) is adopted by reference and incorporated herein as if set forth in its entirety, is hereby adopted as the housing code for the Town of Hastings, Florida.

Sec. 4-3. Standard Fire Code. The 1998 Edition of the Standard Fire Prevention Code, including appendices, as promulgated by the National Fire Protection Association, Inc. is hereby adopted as an Ordinance of the TOWN by reference as through it were copied fully herein.
