Chapter 5

Code Enforcement.

Sec. 5-1. Code Enforcement Officer. The TOWN COUNCIL hereby designates the TOWN CLERK as Code Enforcement Officer pursuant to the requirements of Section 162.21, Florida Statutes (1993). In addition, the TOWN CLERK may designate as her agent a representative of the St. Johns County Building Department as Code Enforcement Officer pursuant to an Interlocal Agreement between the TOWN and COUNTY for the provision of such services.

Sec. 5-2. Creation of Code Enforcement BoardThere is hereby created one code enforcement board for the Town of Hastings, Florida. The authority to create the code enforcement board is found in Chapter 162.03(1), Florida Statutes. The code enforcement board shall have all powers and duties as provided in Chapter 162, Florida Statutes, as amended from time to time, and shall follow the procedures set forth in said Chapter.

Sec. 5-3. Membership of Code Enforcement Board Membership on the code enforcement board shall consist of five persons who shall be citizens of the Town. Appointments to the code enforcement board shall be made by the Town Council in accordance with applicable law and ordinances on the basis of experience or interest in the subject mater jurisdiction of the code enforcement board.

Sec. 5-4. Staggered termsThe initial appointments to the code enforcement board shall be as follows:

a. One member appointed for a term of one year.

b. Two members appointed for a term of two years each.

c. Two members appointed for a term of three years each.

Thereafter, any appointment shall be made for a term of three years.

Sec. 5-5. Reappointment A member may be reappointed upon approval of the Town Council.

Sec. 5-6. VacanciesThe Town Council shall make any appointment necessary to fill any vacancy in the code enforcement board. An appointment to fill a vacancy shall be for the remainder of the unexpired term of office.

Sec. 5-7. Failure to attend meetings. If any members fail to attend two or three successive meetings without cause and without prior approval of the chairman of the code enforcement board, the code enforcement board shall declare the member's office vacated and such vacancy shall be filled as for any other vacancy.

Sec. 5-8. Election of Chairman -- QuorumThe members of the code enforcement board shall elect a chairman from among the members of the board. The presence of three or more members shall constitute a quorum of the board. Members shall serve without compensation but may be reimbursed for such travel, milage and per diem expenses as may be authorized by the Town Council or as otherwise provided by law.

Sec. 5-9. Attorney for Board The attorney for the Town Council shall serve as counsel to the code enforcement board.
