Chapter 6

Fire Protection.

Sec. 6-1. Consent to Municipal Service Benefit Unit. The Town of Hastings hereby consents to the inclusion of all of the incorporated area of Hastings within a municipal service benefit unit created by the County to provide fire protection services, facilities, and programs and to the imposition of a special assessment for such purposes. Such consent shall become effective upon adoption of this ordinance for the upcoming fiscal year. The Town Council of Hastings finds that the provision of fire protection service is an essential municipal purpose.

Sec. 6-2. Annual Renewal of Consent. Consent of the Town Council of Hastings given to the County by Section 7-1 hereof shall be deemed given in advance for each fiscal year hereafter and shall be automatically renewed for each succeeding fiscal year unless such consent is subsequently withdrawn as provided herein. Consent shall be irrevocable for any fiscal year in which the subject fire protection assessments are levied by the County within the incorporated area. Hastings may only withdraw such consent for any subsequent fiscal year by adopting an ordinance to the County prior to June 1 preceding the fiscal year for which consent is being withdrawn.

Sec. 6-3. Fires -- Employment of teams, wagons and vehicles. In case of fire or upon an alarm of fire any member of the Fire Department having any part of the apparatus in charge shall have authority to employ any persons, horse or horses, dray, wagon or vehicle to assist in getting apparatus to the fire and for such service the owner of such animal or vehicle shall be entitled to receive tow dollars for a single team, and three dollars for a double team. In such emergency if the owner driver refuses to consent to the use of such team, the same may be impressed into service shall beheld a service for the public good and the Town shall not be required to pay therefore, and the person impressing such team into service shall not be liable therefore,

Sec. 7-4. Fires -- Able-bodied men to assist. Upon an alarm of fire all able bodied male inhabitants of the Town may be required to assist in the extinguishments thereof, or in the removal of property, or to perform any duties thereat, under the direction and control of the Fire Department. Failure or refusal of any inhabitant to obey the reasonable orders of any officer of the Fire Department on duty in the extinguishments of fire shall be an offense against good order and this Ordinance, rendering the person liable to instant arrest, and upon conviction to a fine not exceeding Fifty Dollars or imprisonment not exceeding ten days. The officers of the Fire Department and the Town Police shall preserve good order and prevent all interference with the firemen apparatus at a fire, and may require all vehicles, women and children to remain at a distance, and all persons not members of the Department to remain beyond certain designated bounds; failure to comply with such requirements shall be deemed an offense against good order and this Ordinance and on conviction punishable by a fine not exceeding Twenty Dollars or imprisonment not exceeding five days; provided that any member of the Fire Department who shall refuse to obey any lawful order of the Chief, or in his absence the ranking Chief or foreman while in command of the Fire Department actually engaging extinguishing fire shall be deemed guilty of an offense against good order and this Ordinance and upon conviction shall be fined not exceeding One hundred Dollars, or imprisoned not exceeding Thirty days. It shall be unlawful to drive or pass any vehicle over the hose after the same is connected with a hydrant or engine, any person violating this provision of this Ordinance shall upon conviction be fined not exceeding twenty-five dollars or imprisoned not exceeding ten days. Any person or persons interfering with or hindering or obstructing any officer of the Fire Department or any person or persons acting under orders of any officer of the Department and actually engaged in the extinguishments of fire, or willfully destroying, injuring, removing or interfering with any property or apparatus of the Fire Department, or the fire hydrants or any of them, shall be guilty of an offense against the good order of the Town and this Ordinance and upon conviction shall be fined not exceeding One Hundred Dollars or Imprisonment not exceeding sixty days.

Sec. 7-5. False Alarms. It shall be unlawful to knowingly turn in or make a false alarm of fire. Any person found guilty of a violation of this section of this Ordinance shall be fined not exceeding One Hundred Dollars or imprisonment not exceeding sixty days.
